Terms And Conditions

 

 

Please read this document carefully as it will tell you everything you need to know about how Efficient Plumbing and Heating Limited conduct their business when we carry out installation work in your home. If you have any questions, please let us know before you accept the quotation.

1. Efficient Plumbing and Heating Limited will carry out the work set out on your quotation for the price that is stated under the following terms and conditions. All prices include VAT, Labour and Material where stated at the current rate.

2. Your quotation is valid for 28 days and we must begin the work within 30 days of your acceptance. After this time your quotation will no longer be valid and you will need to get a revised quotation from Efficient Plumbing and Heating Limited unless otherwise stated by us.

The price Efficient Plumbing and Heating Limited quote does not include the cost of removing any dangerous waste materials, such as asbestos, that we could not reasonably identify when we gave you your quotation. You can and may need to call a specialist contractor to remove these dangerous materials or we may be able to arrange for them to be removed at an extra cost. Once asbestos is removed you will need to produce a ‘site clearance for reoccupation’ certificate, which you can get from the asbestos removal company, before we can continue to work at your property.

3. If your existing boiler to be removed by Efficient Plumbing and Heating Limited contains cement based asbestos then only the minimum amount of asbestos will be removed to safe guard the engineer, customer and property from unnecessary exposure to asbestos. If the customer would like ALL asbestos removed (cement based or otherwise) then they will need to make further arrangements with a licensed asbestos removal company to remove any left over asbestos once Efficient Plumbing and Heating Limited work is complete.

The customer is liable for any asbestos related works, and any costs relating to the presence of this material in their property.

3a. Efficient Plumbing and Heating Limited use a registered and licensed waste collection company to remove the waste/rubbish produced from our work only from site. Efficient Plumbing and Heating Limited will leave all rubbish in the front garden or a location accessible to the waste company should the customer not be home to collect in a location agreed with by the customer/tenant or landlord. The rubbish will be boxed or bagged ready for collection and left as neatly and un-intrusive as possible. The waste collection company are not part of Efficient Plumbing and Heating Limited in any way and any damaged caused in the removal of the rubbish from site will be down to the waste collection company to rectify or compensate, if this was to happen Efficient Plumbing and Heating Limited must be informed immediately so concerns can be raised with the third party. Efficient Plumbing and Heating Limited will ensure a fair resolve for all parties.

3b. Rubbish should be cleared within 7 working days from site!

3c. Scaffolds – Efficient Plumbing and Heating Limited use a registered and licensed scaffolding company to erect scaffolds for our engineers to access flues safety and securely. Efficient Plumbing and Heating Limited will ensure the contractor erects the scaffold on location agreed with by Efficient Plumbing and Heating Limited and the customer/tenant or landlord. The scaffold will be as neat and un-intrusive as possible. The scaffold company are not part of Efficient Plumbing and Heating Limited in any way and any damaged caused in the removal or erection of the scaffold on site will be down to the scaffold company to rectify or compensate, if this was to happen Efficient Plumbing and Heating Limited must be informed immediately so concerns can be raised with the third party. Efficient Plumbing and Heating Limited will ensure a fair resolve for all parties.

3d. Scaffolds should be cleared within 14 working days from site!

4.The price Efficient Plumbing and Heating Limited quote includes removing all non-dangerous materials related to the installation quoted, including your old boiler and central heating parts as a replacement or repair.

5. Any time frames Efficient Plumbing and Heating Limited give you are our best estimates and we will do what we can to keep to those time frames. Efficient Plumbing and Heating Limited cannot be held responsible for work taken longer or shorter than the estimated time frame given and compensation will not be given if the work was to over run.

Where there are likely to be delays Efficient Plumbing and Heating Limited will let you know as soon as possible and agree new time frames with you. The time it takes Efficient Plumbing and Heating Limited to complete the work has no effect on the price quoted to you.

6. All work will be completed to a high standard regardless of how long the work has taken to complete. Efficient Plumbing and Heating Limited may need you to lift carpets or take up all or some other floor coverings, to include but not limited to; tongue-and-grooved floor coverings and parquet hardwood, rubber or tiled floors, so we can complete the work. Efficient Plumbing and Heating Limited will give you as much notice as possible if we need you to do this. You can call a specialist contractor to do this work or we may be able to do it for you at an extra cost. If Efficient Plumbing and Heating Limited, do any of this work for you we will only be responsible for any unnecessary damage caused directly by our negligence and it will be your responsibility to put the flooring back once the work is completed.

6a Efficient Plumbing and Heating Limited cannot be held responsible for damages to floor boards, flooring or joists due to removal of existing pipework or the installation of new pipework. If any of these are in need of replacement, then this will be at extra cost to the customer. Efficient Plumbing and Heating Limited will take care to carry out the work without causing damage to your property. If we cause unnecessary damage because of negligence we will put it right. Sometimes the work means we have to create access if there is not enough pipework or wiring in place to install the boiler, and this can cause damage to things like inside and outside finishing’s such as wall coverings, plasterboard walls/ceiling and paint. You may need to redecorate, repair, plaster or restore certain areas once the work is completed – this is not included in the price we quote and you will be responsible for this. Efficient Plumbing and Heating Limited are a plumbing and heating business and do not preform building works, plastering or making good unless other stated as part of our quotation.

6b Efficient Plumbing and Heating Limited reserve the right to be allowed back to a property to rectify/or be allowed to put right any defective work suspected to be caused by Efficient Plumbing and Heating Limited and its engineers. If you will not allow us back for any reason to rectify, fix, prove or test any defects or damage claims or have any work fixed, repaired or replaced before we have had the chance to view and discuss the cause and damage that you hold as liable for, we will not pay or contribute to any third parties to put right any of our work or damaged caused.

6c Efficient Plumbing and Heating Limited cannot be held responsible for any leaks that occur on existing pipe work. Should any new or existing pipe work need to be run in plastic of any kind, once a water test has been carried out on the day of installation to prove the pipework is water tight then Efficient Plumbing and Heating Limited will provide no guarantees and cannot be held liable thereafter that the fitting or plastic pipework will remain water tight for any further period once we have left the property.

6d Unless otherwise stated, Efficient Plumbing and Heating Limited will provide a 30 day labour gaurantee on all new copper pipework that has been fitted by us! If the part is found to be defective by inspection by ourselves or it is out of its 30 day period then the labour element will become due and chargeable thereafter.

6e Any newly installed appliance IE a boiler or shower unit will have its own manufactures warranty period (please check you appliance instructions) which is not part of Efficient Plumbing and Heating limited. Any defective product IE boiler or showers unit, which becomes faulty during its warranty period that isn’t a direct fault of Efficient Plumbing & Heating Limited then any labour element will be chargeable at our current hourly rate to fix or repair/replace.

7a. Our quotations do not include the painting of radiators, pipework or redecoration, nor for additions to the cold water, or secondary services, alteration to linen cupboard shelves. No allowance has been made for chasing or boxing-in wiring or pipework, unless specifically detailed in the quotation.

8. If you are a tenant, you will need your landlord’s permission before you can allow us to start the work, and we may need you to give us evidence that you have got this permission. If we carry out work at the landlord’s property and you have not got permission or have given us false or inaccurate information, you will compensate us for any losses Efficient Plumbing and Heating Limited suffer because of your failure to get your landlord’s permission.

8a. The customer and or tenant shall be responsible for providing the following facilities which are not included in the contract price and are to be expected and produced or be available to the engineer to proceed with the work. These are:

a) Parking permits where applicable.

b) Convenient access to, on and around the dwelling.

c) Fully functioning gas supply to property.

d) Electrical power supply for power-driven tools, and lighting.

e) Obtaining all necessary licenses, authorities and permissions.

8b. Any fines, parking or otherwise received as a result of section 8 or 8a not being fore filled by the customer/tenant or landlord will result in this cost being added on for payment to the person paying the invoice.If your property is a listed building, it is your responsibility to make sure that you get any permission you need before we start the work, and we will need evidence from you that you have got this permission. We will not be able to start any work if you have not got the appropriate planning permission or if you are unable to give us evidence that you have this permission. If we carry out work at your property and you have given us false or inaccurate information, you will compensate us for any losses Efficient Plumbing and Heating Limited suffer because of your failure to get the permission you needed, which may include court fines and penalties.

9.Efficient Plumbing and Heating Limited quotation is made on the assumption that the existing system is in good working order; any condition or warranty expressed or implied is restricted to the boiler and materials detailed in the specification and the installation thereof by Efficient Plumbing and Heating Limited. No responsibility is accepted for the efficient or effective working of the existing system and or existing controls.

10a. All new boilers require an annual service to maintain safe working and operation. This is also terms and condition of most boiler manufactures to ensure warranties period are upheld (Refer to specific boiler installed instructions). Failure to comply with this could result in the manufactures not upholding your warranty and as a result Efficient Plumbing and Heating Limited can not be held responsible, it is down the the customer to arrange their annual gas check or landlord check. Where Efficient Plumbing and Heating Limited have connected new equipment to your existing system, we cannot accept responsibility for the cost of repairing or replacing parts of your existing system that later develop faults.

11a. Efficient Plumbing and Heating limited cannot test fully the gas pipework until the gas appliance we are installing has been fitted. The gas pipework from the meter to the boiler will need to suitable to supply that appliance with the correct volumes of gas once the appliance has been installed. Where we have not quoted upfront to replace the gas pipework, the pipework will need to be upsized to the correct size to allow sufficient gas volumes to that appliance. This will be a chargeable extra on the job, if the customer refuses to pay for the extra pipework, Efficient Plumbing and Heating will have no other option but to isolate the appliance until the customer has the pipework upgraded. Efficient Plumbing and Heating will accept no responsibly for the entire job unless we are the commission engineers and are allowed to carry out this work!

12. Efficient Plumbing and Heating Limited will test your water supply pressure before we start work. As water supply rates can change, we cannot be responsible for your central-heating system failing to work properly because your water supply becomes inadequate or keeps changing, unless we were negligent in how we tested your water pressure. Efficient Plumbing and Heating Limited always recommends you buy a Power Flush with your installation to remove sludge and other waste from your central heating system and for a thorough deep clean of the whole system.

13a. Efficient Plumbing and Heating Limited also recommends that you purchase lime scale protection and or magnetic filtration protection with boiler products to unsure smooth and efficient operation of the appliance.Efficient Plumbing and Heating Limited will accept no responsibly for damage caused to boilers and or the system and its controls for not installing these products or not having a power flush.

13b. If Efficient Plumbing and Heating Limited have quoted for a power flush of your heating system the engineer will do his/her up most to ensure the system is cleaned as thoroughly as possible within a 1 working day time frame, If the system is still dirty after 1 full working day, additional flushing may be required at an extra charge. If the customer disagrees with the extra charge then Efficient Plumbing and Heating Limited will take no responsibility for any damage the remaining dirt or sludge causes to any part of the heating system, boiler, cylinder or controls there after.

14.Efficient Plumbing and Heating Limited will carry out the work as quickly and efficiently as possible, we use our approved installers. All installers that we use are fully qualified, Gas Safe Registered Number – 220559 and carry identity cards. We are responsible for the installers we use, but the sole responsibly of all gas work and its testing/commissioning will lie with the installing engineer who carried out the work.

14a. To complete your central heating installation as quickly as possible, Efficient Plumbing and Heating Ltd may need to use sub-contractors. Each subcontractor is approved by Efficient Plumbing and Heating Ltd to ensure high standards of work and will answer and be paid directly by Efficient Plumbing and Heating Limited.

14b. Efficient Plumbing and Heating Limited will hold no responsibility for under hand work done between the customer and engineer or sub contract engineer. If Efficient Plumbing and Heating Limited learned of any of these circumstances the engineer in question will be instantly dismissed and none of the work carried out under these circumstances will be honored, condoned or warranted by Efficient Plumbing and Heating Limited.

The customer agrees to pay the balance owing to the engineer and or a company representative of Efficient Plumbing and Heating Limited at the point/day of the completion of works, therefore must be available at this time at the end of the installation on that day. Installation explanation, commissioning certificate/documentation and satisfaction/feedback notice/forms are also required to be signed by the customer and handed to the engineer at the point of to be completed – any return visits required due to customer unavailability will be chargeable to the customer.

15.Interim payments may be requested should completion be delayed by the customer. Cheques are no longer accepted as form of payment, Cash, card payment or BACS is the preferred method. Note 2% charge of the total amount payable will be added to the invoice if paying by credit card.

15a. All materials and appliances fixed or unfixed remain the property of Efficient Plumbing and Heating Limited until paid for in full. All unfixed materials on site at completion of installation works will remain the property of Efficient Plumbing and Heating Limited. All materials on site fixed or unfixed are at the sole risk of the customer and in any event of the same being damaged, destroyed or stolen, will be entitled to full payment thereof.

15b. Any tools or equipment left on site with the customers permission will then become the responsibility of the customer to look after these and safe guard them form thief, loss or damage until the engineer returns the next working day. Should this arise the customer will take full responsibility and will be charged for the replacement. All orders/accepted quotations are subject to acceptance by Efficient Plumbing and Heating Limited and we reserve the right to cancel at any time.

16a. Should the customer wish to cancel this arrangement before 7 days of commencement of work with no penalty, you may do so by expressing your right by telephone and confirm in writing to Efficient Plumbing and Heating Limited.

16b. Cancellations by the customer within 7 days before work is due to commence; Efficient Plumbing and Heating Limited will be entitled to the full cost of equipment specially ordered for the contract, which then becomes the property of the customer.

17. Your personal information will always be keep confidential and never sold on to third parties:

18. We may use your information to do the following:

18a. Provide you with the services you have asked for (which may include loyalty and incentive schemes).

18b. Contact you for future maintenance required, such as your annual boiler service.

18c. Contact you in any way including by post, email, phone, text message or other forms of electronic communications about products and services we are offering.

18d. If we have been asked (for example by Of gem or a lawyer) to provide information for legal or regulatory purposes;

18e. As part of any current or future legal action;

18f. We may pass your address, property and postcode, and details of your gas appliances, flue, hot-water cylinder, system controls and electrical installations (including details of any repairs or removals) to organizations that supervise these activities, including Gas Safe (which replaced CORGI) and the ECA (Electrical Contractors Association). These organisations may pass this information to local authorities to meet building regulations. They may also use this information to contact you to inspect appliances or systems, recall faulty products and carry out audits. They may also use this information for health and safety purposes.

Where appropriate, we will give you or the property owner (or both) a certificate to show that your appliances meet building regulations.

19. Boilers and our workmanship are guaranteed for a minimum of 12 months from the date of installation. Longer duration’s apply if specified in our quotation.

20. Your quotation, together with these terms and conditions, sets out the entire agreement between you and us.

21. Complaints. We MUST be informed of any complaints as soon as possible. We would need to come out and assess any leak claims and agree between both parties a course of action. We will NOT pay out for work carried out on our behalf without our proir consent or agreement if we haven’t attend site and made our own conclusions. Where we cannot resolve any complaints using our own complaints procedure, and insurances. as a Trusted trader we use Ombudsman Services Ltd for dispute resolution. In the unlikely event of a complaint arising and you wish to refer the complaint to them please contact trading standards who can guide you further.
